Terms of Service

These Terms of Service ("Terms") govern your access to and use of the RevCatch platform, websites, and services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms.

1. The Service

RevCatch provides AI-assisted call capture and lead-recovery software for automotive dealership parts departments. The Service captures inbound call details, organizes leads, and delivers operational notifications to authorized dealership personnel and RevCatch staff.

2. Accounts & Eligibility

The Service is a business-to-business product. Accounts may only be created and used by businesses and their authorized representatives (for example, dealership owners, parts managers, and authorized employees). You are responsible for the accuracy of the information you provide, for maintaining the confidentiality of your account credentials, and for all activity under your account.

3. Subscriptions & Billing

The Service is offered on a paid basis, which may include a one-time setup fee, a recurring monthly subscription, and any applicable free-trial period. Fees are billed through our payment provider (Stripe), and recurring charges continue until cancelled in accordance with your plan. Except where required by law, fees are non-refundable.

4. Acceptable Use

You agree not to misuse the Service, including by attempting to access it without authorization, interfering with its operation, or using it in violation of applicable law (including telecommunications and consumer-protection laws). You are responsible for ensuring you have a lawful basis to process any caller or customer information you handle through the Service.

5. SMS / Text Messaging Program Terms

Program name: RevCatch Account & Lead Alerts.
Description: RevCatch sends transactional, account-related text messages to users and authorized personnel who opt in. Message categories include account and welcome notifications, free-trial status and reminder messages, billing and payment confirmations, and captured-call and lead-callback alerts. This is a transactional program and is not used for promotional or marketing solicitation.
How to opt in: You opt in by providing your business phone number and checking the SMS consent box during signup or onboarding. SMS consent is separate from these Terms and is not a condition of purchase.
Message frequency: Message frequency varies based on your account activity and the events that trigger notifications.
Message & data rates: Message and data rates may apply, depending on your mobile carrier and plan.
Opt-out: Reply STOP to any message to unsubscribe at any time. You will receive a one-time confirmation, after which no further messages will be sent unless you re-enroll.

Carriers: Carriers are not liable for delayed or undelivered messages, and supported carriers may vary. Mobile opt-in information and consent are not shared with third parties or affiliates for marketing purposes; for full details on how we handle your information, see our Privacy Policy.

6. Intellectual Property

The Service, including its software, content, and trademarks, is owned by RevCatch and its licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms. Data you submit remains yours, and you grant us the rights necessary to process it to provide the Service.

7. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted or error-free.

8. Limitation of Liability

To the maximum extent permitted by law, RevCatch will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising out of or related to your use of the Service.

9. Termination

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate access for violation of these Terms or as required by law.

10. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last Updated" date above. Continued use of the Service after changes take effect constitutes acceptance.
